Symphony Terms of Use

Symphony provides a personalized monthly subscription service that allows our members to access audiovisual content (“Symphony’s content”) over the Internet on Internet-connected TVs and/or computers (“Symphony devices”).

These Terms of Use govern your use of Symphony’s website, https://symphony.live/, where Symphony’s Service is offered. “Symphony’s Service” means the service provided by Symphony for accessing Symphony’s content which also includes Symphony’s website with all its different functionalities, all the content provided or associated with Symphony’s Service, the recommendations system, the reviews produced and software/s used by Symphony. There are certain features of the Service that may be subject to additional guidelines, terms, or rules, which will be posted on the Site. The additional guidelines, terms, or rules are incorporated by reference into these terms.

These Terms apply to all visitors of Symphony’s website and users of Symphony’s Services.

These Terms of use create a legal agreement between you and Symphony. This means that you should carefully read the Terms and Conditions and our Privacy Policy as they explain the rules regarding the use of the Service and describe the rights and duties you will have with Symphony if you accept them. By accessing or using the Service you are acknowledging and agreeing to have fully comprehended and accepted these terms and our Privacy Policy. If you do not agree with these Terms of Use or with our Privacy Policy you must refrain from accessing or using Symphony’s website. You need to be at least 18 years old in order to be able to accept these Terms of Use. By using this website you represent and warrant that you are at least 18 years old and you must not access or use the Site if you do not comply with this or other requirements stated in this Terms of Use Agreement.

1. Symphony’s operation through Third Parties Websites and Applications and Platforms.

1.1. Symphony may use third parties websites, applications and/or platforms to provide its services. To add, you should be aware that Third parties platforms may also contain their own Terms of Use and Privacy Policy that you should read carefully and accept in order to use Symphony’s Services as they are part of Symphony’s Terms of Use.

1.2 . Our monetization partner Cleeng B.V. (“Cleeng”) handles the management of access to content and/or subscriptions and payment and billing as our agent on our behalf. For this purpose, Cleeng will act as the merchant of record on our request. The services of Cleeng are subject to the terms and conditions of Cleeng, which are hereby incorporated, please refer to https://cleeng.com/cleeng-user-agreement.

2. Modifications to the Terms of Use.

We may modify the Terms of Use Agreement occasionally in order to comply with the legal requirements and/or for other justificatory reasons such as improving the use of the service or making technical adjustments to it. Any modification to the agreement will be notified to you appropriately such as by sending you an email or by a clear notice through Symphony’s service. You are responsible for providing us a valid email address. We will notify you of the modifications in advance and you need to have the option to accept or deny the changes that have been made in Symphony’s service. You will need to accept the changes in order to be able to continue using Symphony’s service after the end of your current billing cycle. If you do not agree to the modifications of the agreements you have the right to terminate your subscription by contacting us. You can contact us by contacting us through our Help Center.

3. Accounts.

3.1 In order to use Symphony’s Services you must create your own account which requires you to provide certain information about yourself by fulfilling a registration form. You can register for an account by clicking here https://symphony.live/?u=login . You are responsible for ensuring that all the information you submit to complete the registration form is truthful and accurate and that you will maintain that information updated. Symphony has the right to suspend or terminate your account at any time at its sole discretion.

3.2 You are the sole responsible for maintaining the confidentiality of your account login. In addition, you are responsible for all the activities performed under your account. You hereby agree to give immediate notice to Symphony about any unauthorized use or suspect of any unauthorized use of your account.

4. Subscription.

You may find information about subscriptions by clicking here https://symphony.live/ . Your Symphony subscription will continue until terminated. Termination may occur if you cancel your subscription before your billing date. If you don’t cancel your subscription before your billing date you authorize Symphony to charge you the monthly subscription fee for the next billing cycle to the Payment Method you have provided. Termination may also occur in the case you had access to Symphony’s services on a free trial and /or promotional basis if, and by the end of this period you did not subscribe to a monthly or annual plan.

5. Payment and Cancellation.

5.1 Payment methods.

In order to use Symphony’s service you must provide one or more payment methods and authorize us to charge the payment method/s provided with your subscription fee. If a payment is not successfully collected from the payment method/s due to any reason and you do not cancel your account, we have the right to suspend your access to the service until receiving a valid payment method.

5.2. Billing.

The monthly subscription fee for the Symphony service will be charged to the payment method indicated by you on the specific payment date as indicated on the “Account” page. You can see your next payment date by accessing your account on https://symphony.live/ and clicking on the “Subscription” link in your “Account” menu.

5.3 Updating your Payments Methods.

You can update your Payment Methods at any time by going to the “account” page at https://symphony.live/u/my-account.

5.4. Renewal and cancellation.

Your paid monthly subscription will renew automatically at the end of the applicable subscription period unless you cancel your subscription before the end of your subscription cycle. You are able to cancel your subscription period at any time by accessing your account page. If you cancel your subscription you will not be able to access Symphony’s service after the date of the end of your current subscription period unless you resubscribe.

Your annual subscription will not automatically renew.

5.5. Changes to the subscription prices.

Symphony may change the price for the monthly subscription and will notify you at least 30 days in advance for you to decide whether or not to accept those changes.

5.6. Customer support.

If you need any further information or support regarding payment, cancellation or any type of assistance with your account, please contact us through our Help Center.

6. Using Symphony’s Service.

6.1. You must be at least 18 years of age to become a member of the Symphony service. Minors may only use the service under the supervision of an adult.

6.2. Symphony’s Service, including Symphony’s access to content, are for your personal and non-commercial use only. You are not allowed to use Symphony’s service for public performances.

6.3 Symphony Service will grant you a limited, revocable, non-exclusive, non-transferable right to access the Symphony service and Symphony content. Symphony’s service and access to its content will remain until termination of the agreement by either you or Symphony.

6.4 Symphony’s content or software applications used are not sold or transferred to you. No right, title or interest shall be transferred to you except from the ones explicitly authorized in these Terms and Conditions. All Symphony’s trademarks, content trade names, logos, domain names and any other feature of Symphony’s company are sole property of Symphony or its licensors.

6.5. By using Symphony’s Services you agree not to engage or attempt to engage in any activity that, in our sole discretion may be consider to be: illegal; violates any third party right (such as the right of privacy, right of publicity, copyright, trademark, intellectual property or patent); interferes with the functionality of Symphony’s Service; accesses or uses the account of another user; download, distribute, transmit, duplicate, commercializes, licenses, (among similar actions) any content offered and obtained through Symphony Services; access without our permission the Service or other third party services accessible through Symphony’s Service.

6.6. Symphony’s content will be regularly updated and may vary by geographic location.

6.7. Symphony has the right to suspend, modify or discontinue the services in whole or in part by giving or not giving you notice and will not be liable to you by it. To add, Symphony is not obliged to update its content.

6.8. Symphony’s website will be updated so you may receive updated versions of the Symphony’s software and third parties’ software licensed by Symphony.

7. Assignment.

7.1. Symphony may assign the Agreements and any of the rights under the agreements, in whole or in part. In addition, Symphony may delegate any of its obligations under the Agreements.

7.2. You may not assign the agreements, in whole or in part, nor transfer or sub-license your rights under the agreements to a third party.

8. Governing Law.

These Terms and Conditions shall be governed by and construed in accordance with the law of the Netherlands. These Terms and Conditions agreements will not limit any consumer protection right that you may be entitled under the laws of your country of residence.

9. Survival.

If any provision or provisions of this Terms and Conditions Agreement is held to be invalid, illegal, or unenforceable, this does not affect the validity, legality and enforceability of the remaining provisions which will remain in force and effect.

10. Communications.

Symphony will send you information relating to your Account by the email address provided in your Account and/or by Symphony’s platform.
